Beatrice homeowners association challenge dismissed

Challenge sought to prevent sex offender from living in southeast Beatrice neighborhood

BEATRICE – A Beatrice homeowners association’s motion to drop its challenge against a convicted sex offender, has been granted by a judge.

Wildwood Estates Homeowner’s Association was recently denied an injunction against Jeff Hawks and a company that owns a residential property in the southeast Beatrice Wildwood Estates area….where Hawks has been residing.

On October 15th, District Judge Christina Marroquin found that the association had not demonstrated a probability of success on their challenge, filed against Hawks and Thayer Farmland LLC.

Hawks, a convicted sex offender, has been a resident of 109 Wildwood Court, which was acquired by Thayer Farmland LLC.   Wildwood claimed association covenants prevent a convicted sex offender from residing in the area.

Judge Marroquin noted that families with children in the southeast Beatrice subdivision “expressed concern” about Hawks’ residency.  But the judge said that concern is nothing more than speculation and that the association must demonstrate a real threat of great or irreparable injury.

Marroquin ordered the case dismissed on Wednesday....each side paying their own legal costs.
