Fired Teacher Wants on School Board that Fired Him
A coach and teacher fired by his school board— accused of ridiculing special education students, swearing, and more— now wants on the board that sent him packing.
And it all comes to a head at the May 12 primary (see our full video report above) because at Omaha's Westside School District the primary is Election Day.
The teacher is John Brian, who was front and center at a day-long public hearing last year:
Brian Testimony: Things that I say sometimes can be misinterpreted.
That was John Brian last year testifying under oath and struggling to keep his teaching and coaching job at Westside High School in Omaha.
It didn’t work.
Fast forward 11 months and Brian’s yard signs dot District 66. He wants on the board that fired him—fired him unanimously—a six-to nothing vote.
School Board President Adam Yale to NCN: "John Brian was terminated by the District for cause."
Those causes laid out in an eight-page public record that finds Brian, who taught at Westside for 20 years, accused of repeated inappropriate and unprofessional behavior. Specifically:
“Making derogatory comments about a female student’s physical appearance.”
“Making comments about a student’s sexual orientation in front of other students.”
“Repeatedly used profanity.
“Telling students to take off their shirts in front of a female staff member in the hallway.”
“Appalling…Inappropriate comments about special education students including asking special education staff, ‘Can you please sanitize this area so those kids don’t reproduce?’”
NCN to Brian: "That's a very specific quote: “Can you please sanitize this area so those kids don’t reproduce?'”
Brian to NCN: “That’s absolutely false.”
In an interview with News Channel Nebraska, Brian repeatedly denied that accusation and the other four as well.
And he denied each and every one when he testified under oath at his May hearing.
But special education teacher Jamie Davis testified that when she asked Brian about the special education slur, which she says heard first hand, Brian had a different answer.
Jamie Davis Testimony: "He didn’t recall saying those, I said yes you did."
Lawyer for School Board to Brian: "Is that what you said during this meeting?"
Brian to School Board Lawyer: "Yes."
School Board Lawyer to Brian: "And I want to be clear. You said you didn’t remember saying it. You never denied saying it did you?"
Brian to School Board Lawyer: "No."
Brian to NCN: "I did never ever once say "Oh, special education students: sanitize so they can’t reproduce.' That’s absolutely false."
NCN to Brian: "So you have denied to me all these allegations?"
Brian to NCN: "I have not denied, well again, unfortunately I thought I was going to be interviewed about my running for the school board but if we’re going to talk about the hearing I would say there were certain things that we’re taken out of context."
Student 1 Testimony: "He’s my favorite teacher."
Student 2 Testimony: "Our whole class has fun with him I mean I just love him as a teacher."
Students testified for Brian and circulated an on-line petition to keep his job.
Brian’s Lawyer to Student 3: "Do you have any idea of where (the petition drive) is right now?"
Student 3 Testimony: "A couple of days ago we broke 19-hundred (names)."
NCN to Adam Yale: "You seem concerned he might be able to win this thing."
Yale to NCN: "I am concerned."
And the school board president is campaigning against Brian, sending out a lengthy Facebook post to stop Brian from “teaching my children or leading my district.”
NCN to Brian: "Why do you want to be on a board that fired you?"
Brian to NCN: "I just want people to have a different voice, if they wish, on the school board."
NCN to Brian: "This isn’t an attempt to get even?"
Brian to NCN: "I think everyone deserves a second chance."
During Brian’s hearing one of the witnesses subpoenaed to testify for Brian was Robert Brousek the head of Brian’s social studies department. According to Brousek, Brian was competent, popular and definitely not boring in class.
Brian’s Lawyer to Brousek: "How can you tell that they’re enjoying it?"
Brousek to Brian's Lawyer: "Well they don’t sleep during it.”
But just a few minutes later Brian's lawyer asked Brousek if Brian should remain as a teacher at Westside.
Brousek paused and then replied, "I don’t know."
