SCHUYLER - A man who fractured a woman's skull by allegedly stomping on it has been sentenced in a separate case for felony child abuse at a Leigh residence.

Eric Schmidt, 37, has been sentenced to 40 to 60 month in jail after pleading no contest to two counts of 3rd degree child abuse in Colfax County District Court on September 7th.

According to court documents, Schmidt's then 13-year-old and 15-year-old step daughters both say he hit the 13-year-old multiple times in the head with a leather belt after she stayed after school for study hall on March 2nd, 2015. The mother of the girls also told the investigating deputy that Schmidt struck the victim with his belt.

Schmidt admitted to hitting his step-daughter with the belt several times, but says it was on the backside, and it was because he went to pick her up from school and she wasn't there. He also said he way angry because the daughter had been “lipping off.”

The mother of the teenagers also told the investigating deputy that Schmidt and she smoked marijuana regularly in front of their children at their home in Leigh.

A count of 3rd degree sexual assault of a child and three additional child abuse charges were dropped.

In a separate case in Platte County, Schmidt is facing charges of stalking and first degree assault after he allegedly attacked the mother at her Columbus apartment on August 21st, 2016. She suffered a fractured skull and brain bleeding and was taken by medical helicopter to UNMC in Omaha.
