SIDNEY, NE — A Cheyenne County Deputy Attorney facing a misdemeanor charge appeared in court Tuesday.

Jackson Osborn pleaded not guilty in Cheyenne County Court to a charge of possession of marijuana. It is a Class III misdemeanor.

Court documents obtained by News Channel Nebraska detail events that led to Osborn's arrest.

According to the arrest affidavit, a Cheyenne County Sheriff's deputy was leaving the county attorney's office when he spotted Osborn in his vehicle in the driveway of the building.

Court documents say the deputy knows Osborn on a personal level and approached the vehicle to say hello. When the deputy got to the car he smelled the odor of burnt marijuana coming from Osborn's car, according to the affidavit.

The deputy wrote in the affidavit, "At this point Jackson Osborn pulled his vehicle away from me quickly and turned west." The deputy reported by the time he reached his vehicle Osborn was nowhere to be seen.

The Cheyenne County Sheriff's Office then obtained a search warrant for Osborn's house and vehicle. Court documents say deputies found 4.6 ounces of a green leafy substance in Osborn's home. A field test kit indicated the substance as marijuana.

According to the affidavit, Osborn told the deputies he was not willing to interview at the sheriff's office. He was then booked into custody.

Osborn's next hearing is scheduled for July, 26.
