A well-known Omaha man accused of threatening to kill the Douglas County Health Director is pushing back on the charges against him.

57-year-old Ron Penzkowski, better known as Ron Gerrard, a former Omaha TV meteorologist and top aide to former Omaha Mayor Jim Suttle, is asking a judge to throw out evidence seized by police during a search.

According to Gerrard, officers did not have probable cause to seize his cell-phone.

He was arrested three months ago and is accused of sending cell-phone emails threatening to "lynch" Dr. Adi Pour and "slice her throat."

If convicted Gerrard, who is out on bond, faces up to four years behind bars.

A court hearing on the search is scheduled for next month
